Introduction

We are ArtifaktNd (individual company of Quentin Faidide). These Terms of Service outline the rules and regulations for using our paid products, including how they are licensed and the responsibilities of users. These terms also applies to paid products we gave away for free.

Our products are either distributed as a software with a license key that you need to activate the software, or as files or software without a license key. The products that are distributed with a license key are designated as "Licensed Software" in this document, while the ones that are distributed as files are designated as "Assets" or "License-Free Software".

Acceptance of Terms

By purchasing, downloading, or using our products, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our software.

License Grant

Upon payment and activation with a valid product key, we grant you a non-exclusive, non-transferable license to use our products for personal or commercial use, as specified at the time of purchase. This license allows you to install and use the software on your devices, but does not permit you to distribute, sell, or share the software with others. Any presets or additional content provided are also subject to these terms.

When you are buying a product from our website, the ownership and license key is tied to the email address you provided. It is used to communicate safely with you, and to send download links. Would you loose access to your email address, you would also loose the ability to download product you have been buying, and we would consider your product license invalid. If you want to change your email address, please get in touch with the support.

User Responsibilities

As a user of our products, you agree to:

- Use the software in accordance with these Terms of Service.

- Not redistribute, sell, or share the software or product key with any unauthorized users.

- Ensure that your use of the software complies with all applicable laws and regulations.

- Report any unauthorized use of your product key or the software to ArtifaktNd (individual company of Quentin Faidide) immediately.

Would you breach these terms, we reserve the right to deactivate or blacklist your license key.

Payment Terms

Payment for our products can be made through our Mearchant of Records. All payments are due at the time of purchase. Prices are subject to change, and applicable taxes will be added to your order as required by law. Upon successful payment, you will receive your product key to activate the software if the product requires one, and a link to download the products that will be valid for 24hours and that can be send again to your email from the website given that the software is still distributed.

Limitation of Liability

To the fullest extent permitted by law, ArtifaktNd (individual company of Quentin Faidide) shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our products or any information, products, or services obtained through the software. Your use of the software is at your own risk.

Distribution Lifetime

We cannot guarantee that our products will still be distributed in the distant future. However, would we cease to operate a website where the products are distributed, we engage in releasing the source code of all of our software products, eventually removing the license verification, and making the paid assets publically available. We also reserve the right to decide to freely distribute our paid products at any time.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles. Any disputes arising from these terms or your use of the software shall be resolved in the courts located in France.

Amendments

ArtifaktNd (individual company of Quentin Faidide) reserves the right to amend these Terms of Service at any time. Any changes will be effective immediately upon posting on our website. We will notify you of any significant changes via email. Your continued use of the software after such changes constitutes your acceptance of the new Terms of Service.
